TERMS AND CONDITIONS
1. Professional Scope & Confidentiality
Miss Erica is a registered member of the National Council of Integrative Psychotherapists (NCIP) and adheres to their Code of Ethical Conduct. Our professional relationship is guided by these standards to ensure your safety and the quality of care provided.
Confidentiality: All sessions are strictly confidential. However, in accordance with the Children Act 1989 and the Care Act 2014, Miss Erica reserves the right to breach confidentiality and contact relevant authorities (e.g., your GP or the police) without your consent if:
There is a significant risk of serious harm to yourself or others.
Disclosure is required by the Terrorism Act 2000 or to prevent a serious crime.
A Court Order is issued.
There is a safeguarding concern regarding a child or vulnerable adult.
No Medical Advice: You acknowledge that these services are not a substitute for medical diagnosis or psychiatric medication. Always consult your GP for clinical medical concerns.
2. Session Conduct & Environment
Privacy & Space: To maintain confidentiality and focus, you must attend sessions from a private, quiet space where you are alone (unless the booking is specifically for a couple's session).
Sobriety Policy: You must be free from the influence of alcohol or non-prescription drugs during sessions. If Miss Erica reasonably believes you are under the influence, she reserves the right to terminate the session immediately. The full fee will be charged, and the session will not be rescheduled.
Technical Responsibilities: You are responsible for ensuring a stable internet connection. Miss Erica is not liable for lost time due to technical failures on the client’s end.
3. Data Protection (UK GDPR) & Records
Data Controller: Miss Erica is the "Data Controller" of your personal information under the Data Protection Act 2018.
Record Keeping: Miss Erica maintains practitioner notes to support the coaching process. These are not verbatim transcripts.
Retention Policy (7 Years): In line with UK professional indemnity insurance requirements and HMRC guidelines, your data and notes will be retained for 7 years following the end of our professional relationship, after which they will be securely destroyed. (For minors, records are kept until the age of 25).
4. Payment, Preparatory Work & No-Refunds
Commencement of Work: Professional services begin the moment a booking is confirmed. Miss Erica performs significant preparatory work (case review and session planning) before the live session.
Waiver of 14-Day Cooling-Off Period: By booking and/or submitting intake forms, you give express consent for work to begin immediately. You acknowledge that you waive your statutory 14-day right to a refund once this preparatory work has commenced.
Non-Refundable Policy: All fees paid for sessions attended or preparatory work commenced are non-refundable.
5. Rescheduling, Expiry & Usage
48-Hour Rescheduling Rule: You must provide a minimum of 48 hours' notice to reschedule. Requests made with less than 48 hours' notice are treated as late cancellations, and the fee is forfeited. Each session may be rescheduled once only.
3-Month Expiry: All sessions/packages must be used within 3 months (90 days) of purchase. Any unused sessions after this window will automatically expire without a refund.
No-Shows: If you fail to attend a scheduled session, it is considered "delivered" and the fee is forfeited.
6. Online, International & Jurisdiction
Time Zones: All sessions are scheduled in UK Time (GMT/BST). Clients are responsible for calculating their local time correctly.
International Compliance: Clients accessing services from outside the UK do so at their own risk and are responsible for their local laws.
Governing Law: This agreement is governed by the laws of England and Wales.
Exclusive Jurisdiction: You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim, regardless of your geographical location.
